\"denied-parties-database<\/a>Superior Freight Services has developed a simple to use program that has consolidated the governments’ lists into one database online.\u00a0 This tool will check batch uploads or single queries to see if you are at risk to making a shipment you will later regret.\u00a0 Superior has also built this program into its shipping forms and will automatically alert all parties involved by email and online if there is any risk at all.<\/span><\/p>\n

Here are\u00a0several steps you should take to avoid dealing with unauthorized parties.<\/span><\/em><\/h2>\n
    \n
  1. Read and understand the “Know Your Customer Guidance<\/a>” provided in the Export Administration Regulations (EAR) and as part of this Web site. It will help you recognize and avoid prohibited transactions.<\/span><\/li>\n<\/ol>\n
      \n
    1. Be familiar with the “Red Flag Indicators<\/a>” that can help you recognize illegal, or potentially illegal, transactions. (See real life case history example.)<\/a> If Red Flags are present you must exercise appropriate due diligence to either resolve questions before engaging in the proposed transaction; or, if questions cannot be resolved, either refrain from the transaction or submit a license application to BIS.<\/span><\/li>\n<\/ol>\n

      1. Check the parties to your transaction (including freight <\/span><\/b><\/span>forwarders<\/span><\/b><\/span>, intermediate consignees, and the ultimate consignee) against key <\/span><\/b><\/span>U.S. Government Lists to Check<\/a> to identify parties subject to denial orders or otherwise restricted or prohibited from engaging in U.S. export transactions. Note that the presence of a party’s name on BIS’s Unverified List<\/a>, which identifies parties whose bona fides BIS has been unable to determine in End-Use Checks, is considered a “Red Flag” calling for you to exercise due diligence (see point 2, above).<\/span><\/strong><\/li>\n<\/ol>\n

        1. If you are being asked to participate in an export transaction that you believe may be illegal, or if you have information that such an illegal transaction may be about to occur, you are encouraged to contact BIS’s Office of Export Enforcement immediately. You may also confidentially report these situations via the Leads and Tips form on this website.<\/span><\/li>\n<\/ol>\n

          Denied Persons List<\/b><\/a> <\/span><\/span>
          \n<\/span><\/a>A list of individuals and entities that have been denied export privileges. Any dealings with a party on this list that would violate the terms of its denial order is prohibited.<\/span><\/p>\n<\/td>\n<\/tr>\n

          Unverified List<\/a> <\/span><\/strong><\/p>\n

          A list of parties where BIS has been unable to verify the end-user in prior transactions. The presence of a party on this list in a transaction is a \u201cRed Flag\u201d that should be resolved before proceeding with the transaction.<\/span><\/p>\n<\/td>\n<\/tr>\n

          Entity List<\/a> <\/span><\/b><\/p>\n

          A list of parties whose presence in a transaction can trigger a license requirement under the Export Administration Regulations. The list specifies the license requirements that apply to each listed party. These license requirements are in addition to any license requirements imposed on the transaction by other provisions of the Export Administration Regulations.<\/span><\/p>\n<\/td>\n<\/tr>\n

          Debarred List<\/a><\/span><\/strong>
          \n<\/span><\/b>A list compiled by the State Department of parties who are barred by \u00a7127.7 of the International Traffic in Arms Regulations (ITAR) (22 CFR \u00a7127.7) from participating directly or indirectly in the export of defense articles, including technical data or in the furnishing of defense services for which a license or approval is required by the ITAR.<\/span><\/p>\n<\/td>\n<\/tr>\n

          Specially Designated Nationals List<\/a><\/span><\/b> (SDN)<\/span><\/b><\/p>\n

          A list compiled by the Treasury Department, Office of Foreign Assets Control (OFAC). OFAC’s regulations may prohibit a transaction if a party on this list is involved. In addition, the Export Administration Regulations require a license for exports or reexports to any party in any entry on this list that contains any of the suffixes “SDGT”, “SDT”, or “FTO”.<\/span><\/p>\n<\/td>\n<\/tr>\n

          Nonproliferation Sanctions
          \n<\/a><\/span><\/b>Several lists compiled by the State Department of parties that have been sanctioned under various statutes. The Federal Register notice imposing sanctions on a party states the sanctions that apply to that party. Some of these sanctioned parties are subject to BIS\u2019s license application denial policy described in \u00a7744.19 of the EAR (15 CFR \u00a7744.19).<\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n
