{"id":4396,"date":"2016-05-19T16:41:08","date_gmt":"2016-05-19T21:41:08","guid":{"rendered":"http:\/\/supfrt.com\/news\/?p=4396"},"modified":"2016-05-19T16:41:08","modified_gmt":"2016-05-19T21:41:08","slug":"export-classification-licensing","status":"publish","type":"post","link":"http:\/\/supfrt.com\/news\/2016\/05\/19\/export-classification-licensing\/","title":{"rendered":"Export Classification &#038; Licensing"},"content":{"rendered":"<p><a href=\"http:\/\/supfrt.com\/news\/wp-content\/uploads\/2014\/04\/Export-sign.jpg\" rel=\"attachment wp-att-2542\"><img decoding=\"async\" loading=\"lazy\" class=\"alignright size-full wp-image-2542\" src=\"http:\/\/supfrt.com\/news\/wp-content\/uploads\/2014\/04\/Export-sign.jpg\" alt=\"Export sign\" width=\"199\" height=\"160\" \/><\/a>Export Classification &amp; Licensing<\/p>\n<p>To verify\u00a0as to whether or not authorization is required to export is determined by the following criteria in the transaction:<\/p>\n<p>1) what is the ECCN of the item<\/p>\n<p>2) where it is going<\/p>\n<p>3) who is the end-user<\/p>\n<p>4) what is the end-use.<\/p>\n<p>While the majority of U.S. commercial exports do not require a license, the first step in this process is determining the correct classification of your item.<\/p>\n<p>Under the EAR (Export Administration Regulations), you should take steps to determine which federal agency has jurisdiction over your item. Here are a few:<\/p>\n<ul>\n<li>U.S. Department of Commerce<\/li>\n<li>Department of State &#8211;\u00a0ITAR (International Traffic in Arms Regulations)<\/li>\n<li>Department of Treasury &#8211; OFAC (Office of Foreign Asset Control)<\/li>\n<\/ul>\n<p>If your item is subject to the jurisdiction of the U.S. Department of Commerce, you must then determine if your item has a specific <a href=\"https:\/\/www.bis.doc.gov\/index.php\/licensing\/commerce-control-list-classification\/export-control-classification-number-eccn\">Export Control Classification Number (ECCN)<\/a> found on the <a href=\"https:\/\/www.bis.doc.gov\/index.php\/licensing\/commerce-control-list-classification\/commerce-control-list-ccl\/17-regulations\/139-commerce-control-list-ccl\">Commerce Control List (CCL)<\/a>. Keep in mind that items subject to the Export Administration Regulations (EAR) that are not listed on the CCL are designated EAR99<\/p>\n<p><strong>There are three ways to determine the Export Control Classification Number (ECCN) for your product.<\/strong><\/p>\n<h4>1. Go to the Source.<\/h4>\n<p>Contact the manufacturer, producer, or developer of the item you are exporting to see if they have classified their product and can provide you with the ECCN. If they have exported the item in the past, it is likely they have the ECCN. Keep in mind that ECCNs may change over time, so please review the ECCN to be sure you are in agreement.<\/p>\n<h4>2. Self-Classify.<\/h4>\n<p>In order to perform a self-classification, you must have a technical understanding of your item, and you need to be familiar with the \u00a0structure and format of the CCL.\u00a0The CCL is divided into ten categories, represented by the first digit of the ECCN. Each of the ten categories is divided into five product groups, represented by the second digit of the ECCN. Once the appropriate category and product group are identified, match the particular characteristics and functions of your item to one of the specific ECCNs that follow.<\/p>\n<p>You can also utilize the <a class=\"doclink\" href=\"https:\/\/www.bis.doc.gov\/index.php\/forms-documents\/doc_download\/13-commerce-control-list-index\">Commerce Control List Index <\/a>to navigate the CCL. Begin by searching for your item on the CCL Index. When you find a potential ECCN, you must then read through the ECCN entry on the CCL before determining if your item fits into the parameters of that ECCN. If the ECCN contains a list under the \u201cItems\u201d heading, broken down into subparagraph(s) it is important to read through these subparagraph(s) to determine that your item meets the technical specifications listed in the ECCN category. You may need to review more than one ECCN description before you find the correct ECCN entry.<\/p>\n<p><strong>3. Request an official classification from the Bureau of Industry and Security (BIS).<\/strong><\/p>\n<p>Submit a commodity classification request online through the <a href=\"https:\/\/www.bis.doc.gov\/index.php\/licensing\/simplified-network-application-process-redesign-snap-r\">Simplified Network Application Process &#8211; Redesign (SNAP-R)<\/a>. You must obtain a Company Identification Number (CIN) before accessing the online SNAP-R system and submitting your request.<\/p>\n<p><strong>4. What if my product is not listed?<\/strong><\/p>\n<p>After careful review of your item against the CCL, if you are convinced your item does not fit into the parameters of any ECCN, your item may be designated as EAR99, keeping in mind it is not controlled by <a href=\"https:\/\/www.bis.doc.gov\/index.php\/about-bis\/resource-links\">another agency<\/a>. If this is the case, your item may be exported using the license exception NLR specifying no license is required, as long as all of the following criteria is met:<\/p>\n<ul>\n<ul>\n<li>The item is not being shipped to a <strong><i><a href=\"https:\/\/www.bis.doc.gov\/index.php\/policy-guidance\/country-guidance\/sanctioned-destinations\">sanctioned destination<\/a><\/i><\/strong><\/li>\n<li>The item is not being shipped to a <strong><i><a href=\"https:\/\/www.bis.doc.gov\/index.php\/policy-guidance\/lists-of-parties-of-concern\">denied person, sanctioned entity, or prohibited end-user<\/a><\/i><\/strong><\/li>\n<li>The item will not be used for a specific <strong><i><a class=\"jcepopup\" href=\"https:\/\/www.bis.doc.gov\/urlmessages\/end_use.html\" target=\"_blank\" type=\"text\/html\">end-use<\/a><\/i><\/strong>, subject to higher controls.<\/li>\n<\/ul>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>EAR99\u00a0items generally consist of low- technology commercial goods and do not require a license in many situations.<\/p>\n<p>An <strong>Export Control Classification Number<\/strong> (ECCN) is an alpha-numeric code such as 3A001, which describes a particular commodity, software or technology and the related technical parameters. \u00a0The ECCN also indicates the types of controls placed on that item.<\/p>\n<p><em>The first digit is Commerce Control List categories:<\/em><br \/>\n<strong>0<\/strong> Nuclear &amp; Miscellaneous<br \/>\n<strong>1<\/strong> Materials, Chemicals, Microorganisms and Toxins<br \/>\n<strong>2<\/strong> Materials Processing<br \/>\n<strong>3<\/strong> Electronics<br \/>\n4 Computers<br \/>\n<strong>5<\/strong> Part 1 -Telecommunications<br \/>\n<strong>5<\/strong> Part 2 &#8211; Information Security<br \/>\n<strong>6<\/strong> Sensors and Lasers<br \/>\n<strong>7<\/strong> Navigation and Avionic<br \/>\n<strong>8<\/strong> Marine<br \/>\n<strong>9<\/strong> Aerospace and Propulsion<\/p>\n<p><em>The second digit is one of 5 Product Groups<\/em>:<br \/>\nA Systems, Equipment and Components<br \/>\nB Test, Inspection and Production Equipment<br \/>\nC Material<br \/>\nD Software<br \/>\nE Technology<\/p>\n<p><em>The third digit is\u00a0the Reason for Control:<\/em><br \/>\n0: National Security (NS)<br \/>\n1:\u00a0Missile Technology (MT)<br \/>\n2: Nuclear Nonproliferation (NP)<br \/>\n3: Chemical &amp; Biological (CB)<br \/>\n9:\u00a0Anti-terrorism (AT), Crime Control, Regional Stability, Short Supply, US Sanctions, etc.<\/p>\n<p>Once you have classified your item and know its reason, or reasons for control, the next step is to review the\u00a0<a href=\"https:\/\/www.bis.doc.gov\/index.php\/forms-documents\/doc_view\/14-commerce-country-chart\">Commerce\u00a0Country\u00a0Chart<\/a>.<\/p>\n<p>The\u00a0Country Control Chart contains license requirements based on destination and reason for control and allows you to determine whether a license is required for an item on the Commerce Control List to any country in the world.<\/p>\n<p>The first column on the Country Chart lists all the countries in alphabetical order. On the horizontal headers (stretching out to the right) identifying the various Reasons for Control. To use the Commerce Country Chart, you match the country of destination with the specific Reason for\u00a0Control of the item.
