When required, the DCS should be included on the exporter\u2019s commercial invoice.<\/p>\n<p><em><strong>The new DCS, which will take effect <span style=\"text-decoration: underline;\">November 15, 2016<\/span> reads:<\/strong><\/em><\/p>\n<p><em>\u201cThese items are controlled by the U.S. Government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end-user(s) herein identified. They may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized ultimate consignee or end-user(s), either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations\u201d<\/em><\/p>\n<p>Beginning regulatory text (amends 15 CFR section 758.6)<\/p>\n<p><strong>PART 758\u2014[AMENDED] <\/strong><\/p>\n<p>1.The authority citation for part 758 is revised to read as follows:<\/p>\n<p><strong>Authority:<\/strong><\/p>\n<p><a href=\"http:\/\/api.fdsys.gov\/link?collection=uscode&amp;title=50&amp;year=mostrecent&amp;section=4601&amp;type=usc&amp;link-type=html\">50 U.S.C. 4601<\/a> <em>et seq.;<\/em> <a href=\"http:\/\/api.fdsys.gov\/link?collection=uscode&amp;title=50&amp;year=mostrecent&amp;section=1701&amp;type=usc&amp;link-type=html\">50 U.S.C. 1701<\/a> <em>et seq.;<\/em> <a href=\"https:\/\/www.federalregister.gov\/executive-order\/13222\">E.O. 13222,<\/a> <a href=\"https:\/\/www.federalregister.gov\/citation\/66-FR-44025\">66 FR 44025<\/a>, 3 CFR, 2001 Comp., p. 783; Notice of August 4, 2016, <a href=\"https:\/\/www.federalregister.gov\/citation\/81-FR-52587\">81 FR 52587<\/a> (August 8, 2016).<\/p>\n<p>2.Section 758.6 is revised to read as follows:<\/p>\n<ul>\n<li><strong>\u2009758.6 Destination control statement and other information furnished to consignees.<\/strong><\/li>\n<\/ul>\n<p>(a) The exporter must incorporate the following information as an integral part of the commercial invoice whenever items on the Commerce Control List are shipped (<em>i.e.,<\/em> exported in tangible form), unless the shipment (<em>i.e.,<\/em> the tangible export) may be made under License Exception BAG or GFT (see part 740 of the EAR) or the item is designated as EAR99:<\/p>\n<p>(1) The following statement: \u201cThese items are controlled by the U.S. Government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end-user(s) herein identified. They may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized ultimate consignee or end-user(s), either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations\u201d and<\/p>\n<p>(2) The ECCN(s) for any 9&#215;515 or \u201c600 series\u201d \u201citems\u201d being shipped (<em>i.e.,<\/em> exported in tangible form).<\/p>\n<p><strong>Note 1 to paragraph (a).<\/strong><\/p>\n<p>In paragraph (a)(1), the term `authorized&#8217; includes exports, reexports and transfers (in-country) designated under No License Required (NLR).<\/p>\n<p><strong>Note 2 to paragraph (a).<\/strong><\/p>\n<p>The phrase `country of ultimate destination&#8217; means the country specified on the commercial invoice where the ultimate consignee or end user will receive the items as an \u201cexport.\u201d<\/p>\n<p><strong>Note 3 to paragraph (a).<\/strong><\/p>\n<p>The phrase `or as otherwise authorized by U.S. law and regulations&#8217; is included because the EAR contain specific exemptions from licensing (<em>e.g.,<\/em> EAR license exceptions and NLR designations) and do not control the reexport of foreign-made items containing less than a de minimis amount of controlled content.
