Trade Compliance – NAFTA Recordkeeping

For Importers:
  • Importers must maintain NAFTA Certificates of Origin and other related records for five years after the date of entry.
  • These records must be maintained in the U.S.

For Exporters or Producers :

  • Exporters and domestic producers that complete and sign NAFTA Certificates of Origin must maintain NAFTA records for five years after the latest transaction date.  These records include:
    • NAFTA Certificates
    • All information related to the sale and production of the finished good.
    • These records must be maintained in the U.S.
NAFTA Recordkeeping Violations
  • Importers and exporters are subject to civil penalties up to $10,000 for violations of NAFTA recordkeeping provisions
