For Importers:
- Importers must maintain NAFTA Certificates of Origin and other related records for five years after the date of entry.
- These records must be maintained in the U.S.
For Exporters or Producers :
- Exporters and domestic producers that complete and sign NAFTA Certificates of Origin must maintain NAFTA records for five years after the latest transaction date. These records include:
- NAFTA Certificates
- All information related to the sale and production of the finished good.
- These records must be maintained in the U.S.
NAFTA Recordkeeping Violations
- Importers and exporters are subject to civil penalties up to $10,000 for violations of NAFTA recordkeeping provisions
