Pennsylvania Company Settles – For Charges of Illegal Exports
The Bureaus of Industry & Security (BIS) reached a civil settlement with Pennsylvania company Amplified Research Corporation in connection with the illegal export of U.S.-origin amplifiers (controlled for national security reasons) to Hong Kong, China, Singapore, Malaysia, Taiwan, Korea, and Thailand.
This settlement~
holds Amplified Research responsible for the failure to exercise sufficient oversight of its export coordinator.
In 2010, it was determined that individuals will be held accountable for willful violations of the Export Administration Regulations (EAR). Person(s) will not be allowed to hide behind the corporate veil. This was the case for Amplified Research’s export coordinator that was sentenced to 42 months in prison related to these exports.
Since Amplified Research voluntarily self-disclosed (VSD), they avoided criminal charges against the company itself and the suspended fine will be waived for the penalty period. This is providing that all commitments are met that includes hiring an outside expert to audit its compliance and recordkeeping.
