Order Waiving Remainder of Denial Order Period
Fiber Materials, Inc. (FMI) of Biddeford, Maine, was issued an order denying export privileges by the BIS (Bureau of Industry & Security) in March of 2007. The denial order was based on FMI’s criminal conviction for violating the Act by knowingly exporting and causing to be exported from the USA to India a component, accessory and controls for a hot isostatic press without having obtained the required export license from BIS. The denial was to be in valid until November 18, 2015.
Subsequently, the ownership & management control of FMI changed. In February 2014, GrafTech International Ltd. submitted a request seeking to terminate the denial order. The request seeks relief on various grounds, including a strong compliance program that has been put into place by FMI/GrafTech.
BIS reviewed the compliance program and then ordered that the remainder of the denial order be waived upon the effective date of the order – December 19, 2014.
