New York Company Charged with Engaging in Prohibited Conduct
Teledyne LeCroy, Inc. engaged in conduct prohibited by the Regulations by exporting oscilloscopes, items included on the Commerce Control List and controlled for nuclear non-proliferation and/or anti-terrorism reasons, from the United States to a university in Beijing – in the People’s Republic of China, without the required BIS licenses. This Chinese entity is an organization listed on the Entity List.
At the time of these transactions, Teledyne LeCroy was aware of the university’s listing on the Entity List and failed to properly screen the Entity List or obtain the required BIS licenses. In addition, Teledyne LeCroy failed to complete accurately complete the SED (Shipper’s Export Declarations).
The Settlement Agreement includes:
- Civil penalty assessment of $75,000
- If the Civil penalty is not paid in full and timely manner, an order may be issued to denying export privileges for a period of one year.
